Shared Obligations and the Responsibility of an International Organization and Its Member States

Abstract Discussions on the allocation of international responsibility between an organization and its member states do not comprehensively engage with role obligations in assigning to and/or members. The present article sets out what will be termed obligations-based approach by exploring phenomenon sharing members, as well implications thereof for their under law. It so focusing practice concluding mixed agreements EU states, which commonly results overlapping is ultimately argued that a distinction should made two types shared order untangle who can held responsible case breach: EU, state(s), or both.
